Terms of Service

These Terms of Service ("Terms") govern your use of the baba mobile application and website baba.gg (together, the "Service"), operated by baba UG, Musterstraße 1, 10115 Berlin, Germany ("baba", "we", "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 12 years old to use baba. If you are between 12 and 18, you confirm that your parent or legal guardian has reviewed and consented to these Terms. We reserve the right to request proof of age or parental consent at any time.

2. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• You may not create accounts for others or transfer your account.
• Notify us immediately at hello@baba.gg if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to:

• Harass, threaten, or intimidate other users
• Upload offensive, illegal, or inappropriate content (including profile pictures)
• Impersonate other people or create fake accounts
• Use the Service for commercial purposes without our written consent
• Attempt to reverse-engineer, scrape, or interfere with the Service
• Manipulate location data or check-in status
• Use baba to organize activities that are illegal or endanger others

4. User Content

You retain ownership of content you upload (e.g. profile pictures). By uploading content, you grant baba a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating the Service. You are responsible for ensuring you have the rights to any content you upload.

5. Lobbies and Check-ins

• Lobbies are user-created sessions for coordinating sports activities. baba does not organize, supervise, or assume responsibility for any real-world activities.
• You participate in sports activities entirely at your own risk. baba is not liable for injuries, accidents, or damages that may occur during activities coordinated through the Service.
• Check-ins expire automatically after 2 hours.

6. Location Data

Certain features require access to your device's location. By enabling location access, you consent to baba using your location data as described in our Privacy Policy. You can revoke location access at any time via your device settings.

7. Push Notifications

With your permission, we send push notifications about friend activity, lobby invitations, and check-ins. You can disable notifications at any time in your device settings or the app's notification preferences.

8. Intellectual Property

The baba name, logo, design, and all associated content are the property of baba UG. You may not use our trademarks, logos, or branding without written permission.

9. Termination

• You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
• We may suspend or terminate your account if you violate these Terms, with or without prior notice.
• We may discontinue the Service at any time with reasonable notice.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Real-time data (occupancy, check-ins) is user-reported and may not be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, baba UG shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. This includes, but is not limited to, injuries during sports activities, loss of data, or service interruptions. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim (if any).

Nothing in these Terms limits liability for intent or gross negligence, or for claims under mandatory statutory provisions (e.g. product liability).

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is Berlin, Germany, unless mandatory consumer protection laws provide otherwise.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
